QN 2.Can there be a crime without criminal? Answer the question in the case of killing another
by a madman.
INTRODUCTION
A crime means an action or omission which constitutes
and offence and is punishable by law. OR. An action or activity considered to be
evil, bad, shameful or wrong. Example they condemned apartheid as a crime against
humanity,also killing someone and others related to it.
The term crime
originated from the middle English (in the sense "wickedness, sin) :via old
French from Latin word "crimen" which means "judgement, offence "
based on corner mean "to judge".Simply we can say that, a crime is an
illegal act for which someone can be punished by government especially a gross violation
of law, grave offense against morality, criminal activity effort to fight crime.
From the act, yes crime can there without
a criminal because a madman is not actually killing another person as his normal action but become an accidentally
issue so that we can not term a madman as a criminal and the term criminal is a broader term we know.
In case of killing another by a madman is not a criminal
as the statements of the question says because the criminal insanity and mental
health or illness describe that people who are changed with criminal offence who
are suffering from mental disorders are dealt with under the criminal law (insanity)
Act of 2006 as amended by criminal law (insanity) of 2010.
If a person is suffering from a mental disorder, they
may be considered unfit to be tried at the start of the trial without judge killing
another whether is bad or good but we consider the situation of a man who killing
another.
In a marder cases, the concept of diminished responsibility
may be used to substitute a verdict of manslaughter. And mental disorder is defined in the 2006 Act as including
;mental illness, mental disability, demontia or any diseases of mind but does not
include intoxication (drunkenness).
Conclusion.
In finding (that is that someone is considered unfit
to be tried) is not a decision on the alleged criminal activity .And we may ask
the question ourselves, why would a madman kill someone?, and can answered that
most killing are much complex than that but they involves codes of honor, belief
system, escalating tensions or simple heat of the moment. A few people believe themselves
superior to others.
These are the "madmen" you probably speak of
though women are almost as prone to this as men, just less likely to get their hands
dirty with actual killing. These people will kill for sports, political gain, greed
and power according to Drac Smith, a psychologist .
